Be Web Inc., with head office located at rue de la Combe 17, 1260 Nyon (Switzerland) and registered under number CHE-164.517.878 (hereinafter referred to as “Be Web Inc.”, “we”, “us” and “our”), in its capacity as data controller, considers the protection of your personal data and the safeguarding of your privacy to be of utmost importance. The purpose of this policy is to inform you of our practices regarding the collection, storage, use and sharing of information that you are required to provide to us through our platform (the “Platform”) accessible from our website or from our mobile applications. This policy, together with our Terms and Conditions of Use and any documents referred to in them, sets out how we treat the Personal Data we collect and that you provide to us. We suggest that you to read this document carefully in order to learn and understand our practices regarding the processing of your personal data.

1. What rights do you have over your Personal Data?

Where required by applicable law, you have the right to obtain a copy of your personal data held by us. Before responding to your request, we may verify your identity and ask you to provide us with further information so that we can respond to you. You may also modify or delete this information by contacting us via the contact form on the site. Please note that we may retain certain information about you where we are required to do so by law or where we have a legitimate reason to do so.

This is the case, for example, if we believe that you have committed fraud or violated our General Terms and Conditions of Use, if we wish to prevent you from circumventing the rules applicable to the Platform or if a judicial authority requires us to provide certain information concerning you, in the context of civil or criminal proceedings. This is also the case for all accounting data, i.e. all payment operations carried out on our Platform and for which we are obligated to keep a transaction history, an invoicing history along with all the technical, statistical and accounting documentation involved in calculating the payment associated with each invoice.

2. The data we collect

By using our Platform, you are required to transmit information to us, some of which is of a nature to identify you directly (”Personal Data”). This is the case in particular when you fill in the form to register for the Platform or when you contact us. This information contains the data necessary for us to take your requests into consideration. This information is mandatory, otherwise we will not be able to deliver the services offered by our platform and you will not be authorized to create an account.

In accordance with applicable legislation and with your consent, where applicable, during each of your visits, we may collect information regarding the devices on which you use our services or the networks from which you access our services, such as, in particular, your IP addresses, connection data, types and versions of internet browsers used, types and versions of your browser plug-ins, operating systems, data about your browsing experience on our platform, including your experience on the various URL pages of our platform, the content you access or view, the search terms used, download errors, the length of time you spend viewing certain pages, the advertising ID of your device, interactions with the page, and any phone number used to contact us. One of the technologies used to collect this information is cookies.

If you have not closed your account, your personal data is archived after a period of 2 years after your last use of the platform. Financial data (statistics, payments, reimbursements, etc.) are kept for the duration required by applicable tax and accounting laws (generally 10 years).

3. How might we use your data?

We use the data that we collect for the purpose of executing the contract concluded between yourself and us and to provide you with the information and service requested, to send you information on our Platform (such as payment confirmations) by email, text message or any other means, to enable you to access your profile on our Platform, to ensure compliance with (i) applicable legislation, (ii) our terms and conditions of use, (iii) our privacy policy, to send you, in compliance with applicable legal provisions and with your consent where required by law, marketing, advertising and promotional messages, or to suggest and recommend goods or services that may be of interest to you. We may also use your data to send you advertising messages that may be of interest to you on social networking platforms or third-party sites. 4. Why do we collect information about you and who do we share it with?

We may share information about you, including Personal Data, with other entities within the Be Web Inc. group for the purposes set forth in this policy. We also work closely with third parties who may have access to all or part of your Personal Data, in particular with our commercial partners who promote their services on our Platform and to whom you may decide to subscribe, or the subcontractors we use for technical services, payment services, identity verification, analytical solution providers and collection companies and credit agencies.

We share your data with third parties only when we use a service provider in connection with the performance of any contract between you and us or to provide or improve our services (e.g. in connection with payments made), as part of the registration process, when we use service engine and analytical solution providers to improve and optimize our Platform, where we are legally obligated to do so or where we believe in good faith that it is necessary to do so in order to (i) respond to any claim against us, (ii) comply with any legal process, (iii) enforce any contract with our affiliates, such as the General Terms and Conditions of Use and this Privacy Policy (iv) in the event of an emergency involving public health or the physical integrity of a person, (v) in the course of investigations and inquiries, or (vi) to protect our rights, property and safety and more generally those of any third party.

In the event that we sell or acquire a business or assets, in which case we reserve the right to share your Personal Information with the potential seller or buyer of such business or assets. If all or part of our assets are acquired by a third party, the data in our possession will, where appropriate, be transferred to the new owner.

In accordance with applicable legislation and with your consent where required, we may aggregate data about you that we receive or send to our business partners, in particular some or all of your Personal Data and information collected through cookies. We draw your attention to the fact that if you decide to let us access some of your information, including your Personal Data, through connection services provided by our business partners, their privacy policies are also enforceable against you because we have no control over the collection or processing of your data implemented by these partners on their own platform.

We store your Personal Data in the European Union. However, the data we collect when you use our Service may be transferred to other countries, some of which may have less protective data protection legislation than the one in force in the country where you reside. This is especially the case for data transmitted to our sub-contractors located outside the European Union, notably in the United States. We might make use of their services.

This is also the case as regards our affiliated companies located outside the European Union to whom we may transfer some of your data in connection with the provision of our services in those countries. In the event of such a transfer, we ensure that the processing is carried out in compliance with this policy and that it is governed by the European Commission’s standard contractual clauses which ensure an adequate level of protection of the privacy and fundamental rights of individuals. Upon request, we can provide you with a list of the countries where we store your data and those where it occasionally passes through.

5. Targeted advertising, and emails you may receive

In accordance with applicable law and with your consent where required, we may use the data you provide to us on our Platform for marketing purposes (for example to (i) send you our newsletters, (ii) send you invitations to our events or any other communications that may be of interest to you and (iii) display targeted advertisements on social media platforms or third party sites).

With respect to promotional emails, you may withdraw your consent at any time by (i) un-checking the relevant box in your account, (ii) clicking on the unsubscribe link provided in each of our communications, or (iii) contacting us directly.

With respect to targeted advertising on social networking platforms (e.g. Facebook, Twitter, Instagram, etc.), you may opt-out at any time by configuring the advertising settings in your account. On third-party sites, you can contact us to withdraw your consent or get help in specific cases where you do not know who to contact or how to contact us.

6. Confidentiality of your password

You are responsible for maintaining the confidentiality of the username and password that you have selected or that we have automatically assigned to you to access your account on our Platform. You agree to keep this password secret and not to disclose it to anyone.

7. Links to third-party sites

Our Platform may occasionally contain links to the websites of our partners or third-party companies. Please note that these websites have their own privacy policies and that we are not responsible for the use made by these websites of the information collected when you click on these links. We invite you to read the privacy policy of these sites before transmitting your Personal Data to them.

8. Changes to our privacy policy

We may need to change this privacy policy from time to time. When necessary, we will notify you and/or seek your consent. You should check this page regularly for any changes or updates to our privacy policy.
